One Laptop per Child Association, Inc. (“OLPC”) warrants this XO Laptop (the “Laptop”) against defects in material or workmanship as follows:

Limited Warranty.

For a period of 30 days from the date you receive the Laptop (the “Warranty Period”), OLPC will repair or replace, at its option, at no charge to you the defective unit. THIS WARRANTY APPLIES ONLY TO THE ORIGINAL PURCHASER AND IS VOID UPON RESALE OF THE LAPTOP. After this 30 day period, you must pay for the replacement unit and repairs. A fee-based service will also be available to those who desire it.

Certain Exclusions.

This limited warranty does not cover cosmetic damage or damage due to acts of God, accident, misuse, abuse, negligence, commercial use, or modification of, or to any part of the Laptop. This limited warranty does not cover damage due to improper operation or maintenance, connection to improper voltage supply, or attempted repair by anyone other than OLPC or its authorized agent. This limited warranty does not cover Products sold AS IS or WITH ALL FAULTS, or consumables [(such as fuses or batteries)]. This limited warranty is valid only in the United States, Canada and Mexico. This limited warranty is invalid if the factory applied serial number has been altered or removed from the Laptop.

REPAIR OR REPLACEMENT, AS PROVIDED UNDER THIS WARRANTY, IS YOUR EXCLUSIVE REMEDY. OLPC SHALL NOT BE LIABLE FOR ANY INCIDENTAL OR CONSEQUENTIAL DAMAGES FOR BREACH OF ANY EXPRESS OR IMPLIED WARRANTY ON THIS PRODUCT. EXCEPT TO THE EXTENT PROHIBITED BY APPLICABLE LAW, ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE ON THIS PRODUCT IS LIMITED IN DURATION TO THE DURATION OF THIS WARRANTY.

Some states do not allow the exclusion or limitation of incidental or consequential damages, or allow limitations on how long an implied warranty lasts, so the above limitations or exclusions may not apply to you. This warranty gives you specific legal rights, and you may have the other rights which vary from state to state.

How to Obtain Warranty Service.

To obtain warranty service, you must call the Toll Free telephone number listed below and speak with a service representative who will review the Replacement Merchandize Authorization (“RMA”) process with you. Please click here for a written description of the RMA process. The representative will request certain proof-of-purchase information to determine whether you are the original purchaser and whether the XO laptop is still under warranty, in which case the representative will attempt to resolve your problem. If the service representative cannot assist you with successfully remedying your problem, you will be assigned an RMA number and detailed information on how to ship the laptop for service.
